In short
- A booking starts after written quote acceptance and payment of a 30% deposit.
- Free reschedule or cancel more than 7 days before the session; see article 7 closer to the date.
- Mix and mastering include up to 2 revision rounds as described on each service page.
- Dutch law applies; consumers may also use courts in their home country where mandatory rules allow.
1. Scope and hierarchy
These terms apply to services provided by Mushyvanta B.V. (Mushyvanta), Bellamystraat 47, 1053 BL Amsterdam, KVK 70336191, VAT NL881526290B01 — phone 020 244 8916, email [email protected].
They apply when you accept a quote as a consumer or business client for vocal recording, mixing, mastering, band recording, podcast recording, rehearsal space or a combination. Specifics in a quote or order confirmation prevail. Our privacy policy and cookie policy inform about data processing but are not contract terms. Where needed, business clients use the data processing agreement.
2. Definitions

3. Quotes and contract formation
A request via contact, phone or email leads to a quote, usually within 2 business days. Each quote states how long it remains open; after that, rates may need reconfirmation. The contract is formed when you accept the quote in writing (email is enough) and the deposit is received. Until then, a time slot is not firmly held.
For distance contracts you receive confirmation on a durable medium (email) with essential details. Browsing the site or sending a message alone does not bind you.
4. Prices and VAT
Rates on services and service pages are indicative incl. 21% VAT, e.g. €109 for Vocal recording, €219 per track for Mixing, €89 for Mastering, €145 for Band recording, €99 for Podcast recording and €49 for Rehearsal space. The quote sets the final price. For business clients we state net amounts where relevant (€90.08 etc.). Extra hours or options only with written agreement.
5. Payment
Deposit: 30% on booking. Balance: consumers before or on delivery or session day; business clients within 14 days of invoice date unless agreed otherwise. Payment by bank transfer; card in studio if arranged. Late payment may incur statutory interest and reasonable collection costs.
Until full payment we may withhold final files; session files are stored under article 10.
6. Right of withdrawal (consumers, distance)
If you are a consumer and conclude a service contract at a distance (email, phone, form), you may withdraw within 14 days without giving reasons, unless an exception applies. Send a clear notice to [email protected] or by post to Bellamystraat 47, 1053 BL Amsterdam.
If you want the session to start before that period ends, ask explicitly. If you withdraw after we started with your consent, you pay a proportionate amount for work done. Withdrawal ends when the service is fully performed within the period after your express request and acknowledgement that you lose the right once performance is complete. Bespoke or heavily personalised work may be excluded where the law allows.
Refunds within 14 days of receiving your withdrawal, via the same payment method unless agreed otherwise.
7. Reschedule, cancellation and no-show

Requests by email or phone, confirmed in writing. Late arrival shortens session time if the next slot is booked. Statutory withdrawal rights remain where they still apply.
8. Cancellation by Mushyvanta
If we must reschedule or cancel (breakdown, illness, urgent reason), we notify you as soon as possible and offer an alternative. If no suitable time works, we refund amounts paid for unperformed services within 14 days.
9. Studio conduct
Hours: Tuesday–Saturday 10:00–22:00; closed Monday and Sunday. Evening sessions by appointment.. Up to 8 people at once in the live room; 3 rooms including a 42 m² live room and 2 iso booths. Minimum age 16; younger only with written guardian consent and a responsible adult present.
Use gear and rooms carefully and follow engineer instructions. No smoking or vaping. We may stop a session for unsafe behaviour; the slot remains chargeable. Damage through fault or negligence is charged to the client. Your own equipment stays your responsibility.

10. Files, delivery and archive
Unless the quote says otherwise: delivery as 24-bit WAV via download link or agreed medium. Remote mix/master work starts once complete, usable source files are received.
We keep session and project copies for 12 months after last activity, then delete unless longer retention is agreed in writing. You are responsible for backups within that window. Formats: master delivery formats.
11. Revisions
Mix and mastering include up to 2 revision rounds as on the relevant service page. One round is a single bundled list of notes. Extra rounds or a new artistic direction after approval are quoted separately.
12. Intellectual property
Your works. Compositions, lyrics and materials you supply remain yours or your rights holders’. You warrant you have necessary rights on samples, covers and used works.
Recordings. When you initiate and pay for recording, producer rights on the phonogram generally vest with you unless agreed otherwise in writing. After full payment Mushyvanta B.V. does not claim exploitation rights that block your use.
Studio materials. Our templates, presets and methods remain our property.
References. We use your name or project as a reference only with written consent.

13. Liability
We perform work with professional studio care. Artistic outcome also depends on your preparation and choices; it is not guaranteed. Liability is limited to direct damage from attributable breach, except where mandatory law says otherwise (including injury or intent).
For business clients total liability per assignment is capped at the invoice total incl. VAT, except intent or wilful misconduct. Indirect loss, lost profit or missed opportunities is excluded where permitted.

14. Complaints
Send written complaints to [email protected] with description and quote reference. We respond within 2 business days with a proposal. If unresolved, disputes go to competent courts (see article 16). Consumers may use the EU ODR platform: ec.europa.eu/consumers/odr.
15. Force majeure
Neither party is liable for failure due to force majeure (e.g. power failure, epidemic, government measure). The affected party informs the other promptly. Unperformed parts are rescheduled or refunded.
16. Governing law and disputes
These terms are governed by Dutch law. EU consumers keep mandatory protections of their country of residence where applicable.
We aim to resolve disputes amicably first. Consumers may bring proceedings in the Netherlands or, where allowed, in their place of residence. Business disputes are preferably brought before the Amsterdam District Court unless mandatory law points elsewhere.
17. Miscellaneous
If a clause is invalid, the rest remains in force. Failure to enforce is not a waiver. We may amend these terms; ongoing jobs keep the version at acceptance. In case of translation, Dutch prevails. Questions: contact or legal notice.
